Acceptable Use Policy
1. General Use
RPTech Software Marketplace provides enterprise software solutions designed to help organizations manage their business operations effectively. This Acceptable Use Policy ("AUP") establishes the rules and guidelines for using our software products, website, and services (collectively, the "Services").
By using our Services, you agree to comply with this AUP. This policy is designed to protect our customers, our infrastructure, and the integrity of our Services. We reserve the right to modify this AUP at any time, and your continued use of the Services constitutes acceptance of any modifications.
The Services are intended for legitimate business purposes. All users of our Services must:
- Use the Services in compliance with all applicable local, national, and international laws and regulations.
- Use the Services in a manner that is respectful of other users and does not interfere with their ability to use the Services.
- Use the Services for their intended purpose as described in the product documentation.
- Maintain the security and confidentiality of their account credentials.
- Promptly report any security vulnerabilities, suspicious activities, or violations of this policy.
- Cooperate with RPTech Software Marketplace in investigating any suspected violations of this policy.
- Accept responsibility for all activities conducted under their account.
2. Prohibited Activities
The following activities are strictly prohibited when using our Services:
2.1 Illegal Use
You may not use the Services for any purpose that is illegal under applicable law. This includes, but is not limited to:
- Activities that violate any local, state, national, or international law or regulation.
- Activities that facilitate money laundering, terrorist financing, or other financial crimes.
- Activities that violate export control laws or sanctions regulations.
- Activities that facilitate human trafficking, child exploitation, or other serious criminal offenses.
- Activities that violate intellectual property rights, including copyright, trademark, patent, and trade secret laws.
- Activities that facilitate discrimination, harassment, or hate speech.
2.2 Reverse Engineering
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or underlying ideas of any software provided through the Services. This includes:
- Attempting to extract source code from compiled software or binary files.
- Analyzing software to identify proprietary algorithms or trade secrets.
- Creating derivative works based on the software without authorization.
- Circumventing or attempting to circumvent any copy protection or license management mechanisms.
- Using automated tools to analyze, decompile, or disassemble the software.
2.3 Software Piracy
You may not engage in any form of software piracy, including:
- Copying, reproducing, or distributing the software without authorization.
- Sharing license keys, activation codes, or other licensing credentials with unauthorized parties.
- Using the software beyond the scope of your license agreement.
- Using stolen, counterfeit, or fraudulently obtained license keys.
- Facilitating or enabling software piracy by others.
- Operating or participating in software cracking, keygen, or piracy websites or services.
2.4 Spam and Unsolicited Communications
You may not use the Services to send unsolicited bulk communications, including:
- Sending unsolicited commercial email (spam) to any recipient.
- Sending bulk SMS, MMS, or other messaging without proper consent from recipients.
- Sending communications that contain false, misleading, or deceptive information.
- Using purchased, rented, or harvested email lists for bulk communications.
- Sending communications that violate the CAN-SPAM Act, GDPR, or other applicable anti-spam regulations.
- Using the Services for phishing, social engineering, or other deceptive practices.
2.5 Fraud
You may not use the Services to engage in fraudulent activities, including:
- Creating false identities or impersonating another person or organization.
- Manipulating data, records, or transactions to conceal fraudulent activity.
- Issuing or processing fraudulent payments or transactions.
- Using the Services to obtain goods, services, or financial instruments through deception.
- Falsifying business records, financial statements, or other documents.
- Engaging in pyramid schemes, Ponzi schemes, or other fraudulent investment schemes.
2.6 Abuse
You may not use the Services to engage in abusive behavior, including:
- Harassing, threatening, bullying, or intimidating any person.
- Stalking, monitoring, or?????? another person without their consent.
- Distributing harmful, obscene, or defamatory content.
- Inciting violence, hatred, or discrimination against any group or individual.
- Engaging in non-consensual surveillance or monitoring of individuals.
- Exploiting vulnerable individuals or groups.
2.7 Unauthorized Access
You may not attempt to gain unauthorized access to any system, network, or data, including:
- Attempting to access systems, accounts, or data that you are not authorized to access.
- Using credentials obtained through phishing, social engineering, or other deceptive means.
- Testing the security of systems without proper authorization.
- Exploiting known or unknown vulnerabilities in systems or applications.
- Using automated tools to scan, probe, or test the security of our infrastructure.
- Intercepting, monitoring, or modifying communications not intended for you.
2.8 License Sharing
You may not share your software license with unauthorized parties, including:
- Allowing users not covered by your license to access or use the software.
- Sharing login credentials or account access with unauthorized individuals.
- Operating the software on systems not covered by your license.
- Enabling concurrent usage beyond the limits of your license agreement.
- Providing access to the software through shared accounts or remote access arrangements.
2.9 Malware
You may not use the Services to create, distribute, or?????? malware, including:
- Creating, distributing, or hosting viruses, worms, trojans, ransomware, or other malicious software.
- Distributing spyware, adware, or other potentially unwanted programs (PUPs).
- Creating or distributing keyloggers, screen capture tools, or other surveillance software.
- Distributing exploits, proof-of-concept code, or tools designed to compromise system security.
- Using the Services as a command and control (C2) infrastructure for malware operations.
- Distributing phishing kits or tools designed to facilitate identity theft.
2.10 High Resource Usage
You may not use the Services in a manner that consumes excessive resources or degrades the experience for other users, including:
- Running automated scripts or bots that generate excessive load on our infrastructure.
- Performing denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
- Using the Services for cryptocurrency mining or other resource-intensive computations.
- Uploading or storing files of excessive size without prior arrangement.
- Running batch processes that consume disproportionate system resources.
- Using the Services in a manner that negatively impacts performance for other users.
3. Content Standards
When using our Services, you must ensure that any content you create, upload, store, or transmit through the Services meets the following standards:
- Content must be lawful, accurate, and not misleading.
- Content must not infringe upon the intellectual property rights of any third party.
- Content must not contain viruses, malware, or other harmful code.
- Content must not be defamatory, obscene, or offensive.
- Content must not promote discrimination, hatred, or violence.
- Content must comply with all applicable laws and regulations.
- Content must be appropriately categorized and labeled where required by law.
- Content must not violate the privacy rights of any individual.
RPTech Software Marketplace reserves the right to review, monitor, and remove content that violates these standards, without notice and at our sole discretion.
4. Enforcement
RPTech Software Marketplace takes violations of this Acceptable Use Policy seriously. We employ various enforcement measures, including:
- Automated Monitoring: Our systems automatically detect potential violations through pattern analysis, anomaly detection, and automated scanning.
- Manual Review: Our security team conducts manual reviews of flagged activity to confirm violations and determine appropriate enforcement actions.
- Investigation: Suspected violations are investigated by our security and compliance team. Investigations may include review of account activity, system logs, and other relevant data.
- Cooperation with Authorities: We cooperate with law enforcement agencies in the investigation of illegal activities conducted through our Services.
5. Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, please report it to us immediately:
- Email: Send a detailed report to info@rptech.com with "AUP Violation" in the subject line.
- Support Portal: Submit a report through the support portal at http://localhost/wms.
- Content: Include as much detail as possible, including the nature of the violation, the parties involved, any evidence available, and your contact information for follow-up.
All reports are treated confidentially. We will investigate all credible reports and take appropriate action. We will not disclose the identity of the reporter to the accused party without the reporter's consent, except as required by law.
6. Consequences
Violations of this Acceptable Use Policy may result in the following consequences, depending on the severity and nature of the violation:
- Warning: A formal warning notice for minor or first-time violations. The warning will be documented and placed on file.
- Content Removal: Removal of content that violates this policy, without prior notice for severe violations.
- Account Suspension: Temporary suspension of your account pending investigation of a reported violation. Suspension may be immediate for severe violations.
- Account Termination: Permanent termination of your account and all associated services for serious or repeated violations. Termination may be immediate without prior notice for severe violations.
- License Revocation: Revocation of your software license without refund for license-related violations.
- Legal Action: Civil or criminal legal action may be initiated against individuals or organizations that engage in serious violations of this policy or applicable law.
- Law Enforcement Referral: We may refer matters to law enforcement authorities where we believe criminal activity has occurred.
The determination of the appropriate enforcement action is at the sole discretion of RPTech Software Marketplace. We may apply multiple enforcement actions simultaneously. All enforcement decisions are final, and we are not obligated to provide prior notice before taking enforcement action.
